to perform, falsification of medical records, failure to report and/or follow up on abnormal
findings, allowing others to harm a patient by failing to properly supervise or failing to report).
ee. Productivity Issues include failure to perform responsibilities or essential functions as per the
job description, failure to meet job requirements (for example, maintaining required licenses and
certifications), failure to perform work in a productive or cost-effective manner, or with a
reasonable error rate, and any conduct adversely affecting efficient or orderly workflow.
ff. Protected Classes are race, color, national origin, ancestry, religion, sex, gender, gender identity,
gender expression, sexual orientation, age, physical disability, medical condition, mental disability,
marital status, pregnancy, veteran status, genetic information and any other protected
characteristic which may be specified in applicable laws and governmental regulations.
gg. Reporting Wrongdoing Issues include failure to report: suspected or actual wrongdoing,
including actions which interfere with or adversely affect work operations; inappropriate behavior;
policy violations; and condoning or supporting such actions. Such reports may be made to either
the employee’s supervisor or the appropriate university office. See Staff Complaint Procedures;

hh. Safety Issues include failure to follow safe work practices, failure to report unsafe work
practices, failure to immediately file accident reports, failure to immediately report safety hazards
to a supervisor or Risk Management. See Health and Safety policies under Administrative and
Business Practices.
ii. Sexual assault is penetration, however slight, of the vagina, anus or mouth by a body part or an
object under any of the below conditions. Sexual contact, another form of sexual assault, is
intentional contact, direct or indirect, of the breasts, genitals, buttocks or groin of another under
any of the below conditions.
i. without their affirmative consent;
ii. where the assailant uses physical force, threat, coercion, or intimidation to overpower
or control another,
iii. where the victim fears that they, or another person, will be injured or otherwise harmed
if they not submit;
iv. where an individual’s ability to give or withhold consent is impaired due to the influence
of alcohol or other drugs;
jj. Title VII of the Civil Rights Act of 1964 is a federal law that prohibits employers from
discriminating against employees on the basis of sex, race, color, national origin, and religion. It
